Overview

This website, https://kimbelo.com (the "Site"), is operated by Dimitri Buckner, doing business as Kimbelo, a sole proprietorship ("we," "us"). By visiting the Site or buying from us, you agree to these Terms of Service ("Terms"), along with our Privacy Policy, Refund Policy and Shipping Policy. If you don't agree, please don't use the Site.

Our store is hosted on Shopify, which provides the e-commerce platform we use to sell our products. Our physical products are made and shipped by our fulfillment partner, Selfnamed.

1. Eligibility

You must be at least the age of majority in your state of residence to use the Site and make purchases, or have the consent of a parent or guardian.

2. Products and product information

Our products are cosmetics intended for external use only. They are not intended to diagnose, treat, cure or prevent any disease, and nothing on the Site is medical advice. Talk to a doctor about any medical condition, pregnancy or use on children.
Please read each product's full ingredient list, directions and cautions before use, and patch test new products.
We try to display product colors, textures and descriptions accurately. Plant oils and extracts can vary slightly in color, smell and texture from batch to batch.
Product availability is limited, and we may limit quantities or discontinue products at any time.

3. Pricing and payment

Prices are shown in US dollars (USD) and may change without notice. We may correct pricing errors, and we may cancel orders placed at an incorrect price. You agree to provide accurate purchase and account information. Payments are processed by our payment providers.

4. Orders

We may refuse or cancel any order, for example if we suspect fraud, if an item is out of stock, or if there's an error in the product or pricing information. If we cancel an order after you've been charged, we'll refund you.

5. Shipping, returns and refunds

Shipping is covered by our Shipping Policy, and returns and refunds by our Refund Policy. Our products are printed with our label and shipped by our fulfillment partner.

6. Reviews and content you submit

If you submit reviews, comments or other content, you grant us a non-exclusive, royalty-free license to use, reproduce and display it in connection with our business. Your content must be truthful and reflect your real experience, and you must disclose any free product, discount or other incentive you received. Our owner, staff and their families don't post reviews of our products on the Site.

We publish genuine reviews, positive or negative, and we never remove or hide a review because of its rating. We apply the same rules to every review, set out in our Review Guidelines: we may remove content that is unlawful, abusive, fake, not about the product or your experience buying it, or that includes personal information. If a review claims a product treats, cures or prevents a disease, or grows or regrows hair, we remove only that part and mark where we did. The rating and the rest of the review stay. Reviews describing a reaction, side effect or bad result are not health claims, and we publish them. We'll also contact the reviewer privately and record the reaction as a product-reaction report.

7. Prohibited uses

You may not use the Site for any unlawful purpose, to infringe anyone's rights, to upload malicious code, to scrape or interfere with the Site, or to submit false information.

8. Intellectual property

All Site content, including text, graphics, logos and images, belongs to us or our licensors and may not be used without our written permission.

9. Third-party links and tools

The Site may link to or use third-party services. We aren't responsible for their content or practices.

10. Disclaimer of warranties

The Site is provided "as is" and "as available," to the fullest extent permitted by law. Nothing in these Terms limits any warranty or right you have under applicable law. Individual results vary.

11. Limitation of liability

To the fullest extent permitted by law, Dimitri Buckner, doing business as Kimbelo, a sole proprietorship, will not be liable for indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product involved. This section does not limit liability for personal injury or property damage caused by our products, for claims under the Washington Product Liability Act or the Washington Consumer Protection Act, or for gross negligence, willful misconduct, or anything else that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify us for losses caused by your intentional misuse of the Site or your violation of law or someone else's rights.

13. Governing law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules. Before filing a claim, please contact us at hello@kimbelo.com and give us 30 days to try to resolve it. Any claim will be brought in the state courts in Thurston County, Washington, or the federal court for the Western District of Washington (Tacoma), except where the law of the place you live gives you the right to bring a claim in your local courts. Either of us may bring an individual claim in small claims court instead. There's no arbitration, and nothing in these Terms takes away a consumer protection right you have under the law where you live.

14. Changes

We may update these Terms by posting the new version on the Site. Changes apply to orders placed after the "Last updated" date. The Terms in effect when you placed an order apply to that order.
